Calif. Low-Carbon Fuel Standard Blocked In Court

A federal judge moved Thursday to block California from enforcing its first-in-the-nation mandate for cleaner, low-carbon fuels, saying the rules favor biofuels produced in the state.

The lawsuit challenging the state regulations, which were adopted as part of California's landmark 2006 global warming law, was filed in federal court last year by a coalition that includes the National Petrochemical & Refiners Association and the Consumer Energy Alliance.

Fresno-based U.S. District Court Judge Lawrence O'Neill's written ruling Thursday said the low-carbon fuel rules violated the U.S. Constitution's commerce clause by discriminating against crude oil and biofuels producers located outside California.

Out-of-state fuels producers hailed the decision as a win for California drivers.

"Today's decision ... struck down a misguided policy that would have resulted in even higher fuel costs for Californian consumers while increasing the cost of business throughout the state," said Consumer Energy Alliance Executive Vice President Michael Whatley.

The board plans to ask the judge to stay the ruling, and appeal if necessary to the San Francisco-based 9th U.S. Circuit Court of Appeals, spokesman Dave Clegern said.

The rule is "an evenhanded standard that encourages the use of cleaner low carbon fuels by regulating fuel-providers in California," Clegern said, adding that it "does not discriminate against any fuels on the basis of geography."

Beginning this year, the standard has required petroleum refiners, companies that blend fuel and distributors to gradually increase the cleanliness of the fuel they sell in California.

The board previously had said the low-carbon mandate will reduce California's dependence on petroleum by 20 percent and account for one-tenth of the state's goal to cut greenhouse gas emissions by 2020.

The regulation does not mandate specific alternative fuels. Rather, it assigns a so-called carbon-intensity score to various fuels. All gasoline and diesel fuel sold in California must be 10 percent less carbon-intensive by 2020.

The Rocky Mountain Farmers Union, the California Dairy Campaign, the Renewable Fuels Associations and other groups filed a similar lawsuit in the same court in 2009. Their complaint said the regulation conflicted with the federal Renewable Fuel Standard and would close California's borders to corn ethanol made in other states.

The fuel standard "discriminates against out-of-state and foreign crude oil while giving an economic advantage to in-state crude oil," O'Neil wrote Thursday.

The nonprofit legal organization Earthjustice, which was not party to the suit but works on climate-related issues, said the ruling was a major setback for the state's aggressive greenhouse gas emission regulations.

"California is leading the way on cleaner fuels and a cleaner power grid, and the state's programs are consistent with federal law," Earthjustice President Trip Van Noppen said. "It is not surprising that the oil industry is attacking these programs, but like previous attacks in the courts and at the ballot box, we expect this one ultimately to fail."

Singer, actress Kaye Stevens dies in Florida (AP)

THE VILLAGES, Fla. ? Singer and actress Kaye Stevens, who performed with the Rat Pack and was a frequent guest on Johnny Carson's "The Tonight Show," has died at a central Florida hospital. She was 79.

Close friend Gerry Schweitzer confirmed that Stevens died Wednesday at the Villages Hospital north of Orlando following a battle with breast cancer and blood clots.

Stevens, a longtime South Florida resident, performed with Rat Pack members including Frank Sinatra, Dean Martin, Sammy Davis Jr. and Joey Bishop. She also sang solo at venues like Caesar's Palace in Las Vegas and the Plaza Hotel's Persian Room in New York City.

During the Vietnam War era, Stevens performed for American soldiers in the war zone with Bob Hope's USO tour.

According to a handout from friend Rhonda Glenn, Stevens was born Catherine Louise Stephens in Pittsburgh. Her family eventually moved to Cleveland, where a teenage Stevens got her start as a drummer and singer. She later married now deceased bandleader and trumpet player Tommy Amato, and the couple performed throughout the eastern U.S.

During a gig in New Jersey, Stevens was discovered by Ed McMahon, Carson's longtime sidekick, which led to new bookings. Her big break came when she was playing a lounge at The Riviera Hotel in Las Vegas. Debbie Reynolds became ill and was unable to perform in the main room. Stevens filled in and was an instant hit.

Besides singing, Stevens also acted in film and television. She appeared in six movies, earning a Golden Globe nomination in 1964 for "The New Interns." She was a regular celebrity player on game shows and appeared as a regular on "Days of Our Lives" from 1974-79.

During the past two decades, Stevens started her own ministry and began performing only Christian and patriotic music. She staged benefits to help build St. Vincent Catholic Church in her longtime home of Margate, Fla., where city officials named a park in her honor.

Domestic policy chief starts, leaves amid crises (AP)

WASHINGTON ? Melody Barnes is leaving as White House chief domestic policy adviser at a time when President Barack Obama's administration is getting little notice for its work on the home front to fix the struggling economy.

Barnes, who will be gone by Tuesday, is quick to point out that there have been many domestic achievements, even though the public is dissatisfied.

"I completely understand what the American public is feeling," she said in an interview in her tidy West Wing office. "Real people are hurting in a significant way. ... At the same time, I'm proud of the things we've been able to accomplish over the last few years."

Her office is wrestling with multiple thorny issues now just as it was when Barnes started as Obama's domestic policy team director in 2009.

Back then, the economy plunged into free-fall and the country was in its worst economic crisis since the 1930s. Jobs were being lost at a rate of about 750,000 a month ? a number Barnes still finds so staggering she said she has to double-check it every time she says it.

Homes were being foreclosed, unemployment was skyrocketing and reaching double the national average in the black community. The wars in Iraq and Afghanistan dragged on, an outbreak of H1N1flu virus became a pandemic, and a tsunami that hit Japan crippled a nuclear plant near Tokyo, to name some of the highlights.

Even her chance to play golf with the president, the first time a woman joined him, came at a time of a public image crisis for Obama. The president was getting flak for playing basketball with men, fostering complaints about a boys' club in the White House.

Just before Christmas, the president and Congress wrangled over a two-month extension of a Social Security payroll tax cut and unemployment benefits. Obama won a victory when the proposal won bipartisan support in the Senate and finally was accepted by House Republicans under extreme pressure.

Barnes, a Richmond, Va., native with a career in government and private sector work, is bowing out of the political arena as Obama struggles with low approval ratings on his handling of the economy.

A majority of Americans do not think the president deserves a second term, according to the most recent Associated Press-GfK poll. But at the same time, the unemployment rate has dropped to 8.6 percent, the lowest level since March 2009. The president's overall approval rating stands at 44 percent, the lowest of his term in AP-GfK surveys.

His strong stance against House Republicans in the payroll tax standoff has caused an uptick in approval ratings in subsequent polls.

Barnes expects the list of legislative victories that she and others pulled off amid the hemorrhaging economy will become more clear in the coming year as the dark clouds of the economy disperse.

She tops that list with the early work to stabilize the economy, 21 months of consistent job growth and the president's long-term investments in education overhaul, an area that became her specialty.

"Our work on education reform, it'll be part of this president's legacy," she said.

Barnes said that with a fraction of what the federal government spends annually on education, about $100 billion, from the American Recovery and Reinvestment Act of 2009, the administration tapped into an education reform movement taking place at the grass roots among governors and local communities frustrated with the prescriptive, one-size-fits-all mandates of No Child Left Behind, the Bush administration's education cornerstone.

Congress has yet to approve revisions to No Child Left Behind, states are using up the stimulus money, and Obama's Race to the Top grant program faces spending cuts. But Barnes said Obama has given a boost to education law changes that now allow such things as connecting student performance and teacher evaluations.

Barnes, chief counsel to the late Sen. Edward Kennedy on the Senate Judiciary Committee, said Obama also deserves credit for passage of a health care overhaul, legislation that she had worked on for eight years with Kennedy. The Massachusetts senator spent his career trying to restructure health care.

There's also the auto industry bailout, expansion of Pell grants to help fund college education, the end of the military's "don't ask, don't tell" policy on gays and work to advance civil rights, she said.

"When you are worried about day to day, it's hard to step back and to take all those other things in," Barnes said. "Although at the same time, I'm literally in the grocery store and people come up to me and say, `Hey, you work for the president. You keep on doing what you are doing.' "

Married a few months into the president's first year, Barnes plans to spend more time with family. She is considering offers in the private sector but hasn't disclosed what those are.

Report: Apple to double the capacity of next iPad battery, release two different models with high megapixel cameras

A report this evening from DigiTimes said the next iPad will have a monster battery that will more than double the current ?6579 mAH?to a whopping 14,000mAH. ?Apple currently uses?battery suppliers Simplo Technology and Dynapack who both denied to comment on the report.

Furthermore,?Apple is set to unveil two versions of its next-iPad, ?One for the high-end segment and one for the mid-range segment? according to another DigiTimes report. ?Strangely, the report said the new iPads will be released at Macworld/iWorld in late January, a show that Apple has no plans to attend right now and bowed out of completely two years ago.

This is extremely unlikely; however, perhaps, a same-time but separate release could happen. ?More details that are interesting were reported, as well?.

Instead of the previously-rumored 7.85-inch, the upcoming iPad models will still feature 9.7-inch screens but come with QXGA resolution (1,536?2,048 pixels), the sources indicated. Dual-LED light bars are designed for the new iPads to strengthen the brightness of the panels, the sources added.

We had heard about the dual LED light bars earlier that may be the cause of the bigger battery and contribute to the thicker iPad. ?Additionally, a report from what became the Verge said an iPad HD was in the works that would run a new Touch version of Final Cut Pro.

Sharp will be the major display provider with Samsung and LG also providing displays, as well. ?Samsung will manufacture the new A6 processor?in Texas that will at least power the high-end version. Additionally, the report said serious cameras are on deck for the new iPads that would boast 5-to 8-megapixel cameras from Samsung and Sony.

Samsung is also among the CMOS image sensor (CIS) suppliers for one of the versions of the new iPad that comes with a 5-megapixel lens, marking the Korea-based vendor?s first time to grab CIS orders from Apple, the sources noted. Sony is the other CIS supplier for the other model with a higher 8-megapixel lens, the sources added.

We have heard earlier reports that the next iPad would be significantly thicker and this might be a reason. ?We have had additional parts, including assembly and buttons, that seem to indicate iPads are currently in production.

More than a million extra Olympics tickets are to be released in the spring.

Organisers say the 1.3million ?contingency? tickets were held back while seating plans were completed and venues tested.???????

The most popular events will? be included in the new sale, such as the opening and closing ceremonies and the men?s 100m finals, swimming and track cycling.

But many fans have been left confused. In June, 1.9million applied for London 2012 through a ballot, and two-thirds ? about 1.2million ? were left disappointed.

Critics have argued that by limiting the supply, organisers conveniently increased demand for tickets.

Even handball, which is little-known in the UK, sold out during the second-chance sale in June, when 2.3million tickets were up for grabs, including 1.6million for football.

Many fans, it appears, were unaware that a million more tickets across all sports would go on sale in 2012. Those who failed to get tickets the first time will go to the front of the queue when the remaining tickets are released.

Hundreds of tickets will go on sale next Friday when people are allowed to sell back their unwanted seats for the first time.

Locog chief executive Paul Deighton said: ?We asked people to buy tickets more than a year out from the Games and mindful of that, we promised that we would create this system for people to resell their tickets legally and safely.?

But he added: ?I?m convinced that most people will want to hold on to their tickets.?

The website is the only legal way to re-sell unwanted purchases. Despite this, tickets have already been advertised by touts on websites including eBay for more than four times the price.

Among them were a pair of mid-range seats for the boxing finals worth ?370 being sold for ?1,036. A pair of tickets for a women?s volleyball match worth ?150 were on offer for ?650.

Organisers insisted that marketplace websites were keeping a close eye on touts and that London 2012 tickets were automatically removed before they could be sold.

The UK ticketing system has received much criticism, with even cycling gold medallist Bradley Wiggins branding the ballot system ?a shambles?.

When the remaining 1.3million tickets are released in the? spring, organisers will abandon? the controversial system in favour of a first-come-first-serve Ticketmaster-style website.

They will? also limit the number of events? for which people can apply to? stop companies and the super-rich from scooping up hundreds of tickets.

Mr Deighton said: ?It is important that the first opportunity is granted to those who were unsuccessful in the first round.

?We will also look at quite strict ticket number applications so that the million tickets get spread across the maximum number of people.?

Some fans, disenchanted by the ballot system, have turned to sellers outside the UK to secure seats at the most popular events.

One million tickets out of a total 8.8million have been allocated for the international market, but anyone in the EU may apply for them.

Dutch web designer Kevin? Plasmans, 25, has created a computer software programme, called OS Site Tracker, which alerts sports fans when their favourite events go on sale anywhere in Europe. It costs ?7.50 to subscribe.

He said: ?Two-thirds of my customers are British and are using it after they couldn?t get tickets through their own country.?

Three Things I Learned from Having Breast Cancer

Once, someone wrote on Twitter that she hates the openings to my posts and likes the rest.

She had a point.

Usually, I just use the beginning as a way to get to the point.

The fun thing about having breast cancer ? read about where my boobs went wrong here ? is that it?s a Learning Experience. You learn about Other People. And How to Deal with Challenges. And along the way you Change and Transform.

It?s like a Gift from God that happens in your Cancerous Breasts.

Here?s what I?ve learned so far.

1. You enter another reality.

Today, I went to go see a person I refer to as my ?Cancer Shrink.? That means he works with the hospital to help women who are diagnosed with breast cancer. I can?t imagine how he does his job. It would make me feel sad, but he is a happy man. I have to conclude it makes him happy.

Early on in the session, he mentioned he was a cancer survivor. Later, I asked him what kind of cancer he had.

He tilted his head to one side and showed me the side of his neck.

'Anonymous' hackers target US security think tank

LONDON (AP) ? The loose-knit hacking movement "Anonymous" claimed Sunday to have stolen thousands of credit card numbers and other personal information belonging to clients of U.S.-based security think tank Stratfor. One hacker said the goal was to pilfer funds from individuals' accounts to give away as Christmas donations, and some victims confirmed unauthorized transactions linked to their credit cards.

Anonymous boasted of stealing Stratfor's confidential client list, which includes entities ranging from Apple Inc. to the U.S. Air Force to the Miami Police Department, and mining it for more than 4,000 credit card numbers, passwords and home addresses.

Austin, Texas-based Stratfor provides political, economic and military analysis to help clients reduce risk, according to a description on its YouTube page. It charges subscribers for its reports and analysis, delivered through the web, emails and videos. The company's main website was down, with a banner saying the "site is currently undergoing maintenance."

Proprietary information about the companies and government agencies that subscribe to Stratfor's newsletters did not appear to be at any significant risk, however, with the main threat posed to individual employees who had subscribed.

"Not so private and secret anymore?" Anonymous taunted in a message on Twitter, promising that the attack on Stratfor was just the beginning of a Christmas-inspired assault on a long list of targets.

Anonymous said the client list it had already posted was a small slice of the 200 gigabytes worth of plunder it stole from Stratfor and promised more leaks. It said it was able to get the credit card details in part because Stratfor didn't bother encrypting them ? an easy-to-avoid blunder which, if true, would be a major embarrassment for any security-related company.

Fred Burton, Stratfor's vice president of intelligence, said the company had reported the intrusion to law enforcement and was working with them on the investigation.

Stratfor has protections in place meant to prevent such attacks, he said.

"But I think the hackers live in this kind of world where once they fixate on you or try to attack you it's extraordinarily difficult to defend against," Burton said.

Hours after publishing what it claimed was Stratfor's client list, Anonymous tweeted a link to encrypted files online with names, phone numbers, emails, addresses and credit card account details.

"Not as many as you expected? Worry not, fellow pirates and robin hoods. These are just the 'A's," read a message posted online that encouraged readers to download a file of the hacked information.

The attack is "just another in a massive string of breaches we've seen this year and in years past," said Josh Shaul, chief technology officer of Application Security Inc., a New York-based provider of database security software.

Still, companies that shared secret information with Stratfor in order to obtain threat assessments might worry that the information is among the 200 gigabytes of data that Anonymous claims to have stolen, he said.

"If an attacker is walking away with that much email, there might be some very juicy bits of information that they have," Shaul said.

Lt. Col. John Dorrian, public affairs officer for the Air Force, said that "for obvious reasons" the Air Force doesn't discuss specific vulnerabilities, threats or responses to them.

"The Air Force will continue to monitor the situation and, as always, take appropriate action as necessary to protect Air Force networks and information," he said in an email.

Miami Police Department spokesman Sgt. Freddie Cruz Jr. said that he could not confirm that the agency was a client of Stratfor, and he said he had not received any information about a security breach involving the police department.

Anonymous also linked to images online that it suggested were receipts for charitable donations made by the group manipulating the credit card data it stole.

"Thank you! Defense Intelligence Agency," read the text above one image that appeared to show a transaction summary indicating that an agency employee's information was used to donate $250 to a non-profit.

One receipt ? to the American Red Cross ? had Allen Barr's name on it.

Barr, of Austin, Texas, recently retired from the Texas Department of Banking and said he discovered last Friday that a total of $700 had been spent from his account. Barr, who has spent more than a decade dealing with cybercrime at banks, said five transactions were made in total.

"It was all charities, the Red Cross, CARE, Save the Children. So when the credit card company called my wife she wasn't sure whether I was just donating," said Barr, who wasn't aware until a reporter with the AP called that his information had been compromised when Stratfor's computers were hacked.

"It made me feel terrible. It made my wife feel terrible. We had to close the account."

Wishing everyone a "Merry LulzXMas" ? a nod to its spinoff hacking group Lulz Security ? Anonymous also posted a link on Twitter to a site containing the email, phone number and credit number of a U.S. Homeland Security employee.

The employee, Cody Sultenfuss, said he had no warning before his details were posted.

"They took money I did not have," he told The Associated Press in a series of emails, which did not specify the amount taken. "I think 'Why me?' I am not rich."

But the breach doesn't necessarily pose a risk to owners of the credit cards. A card user who suspects fraudulent activity on his or her card can contact the credit card company to dispute the charge.

Stratfor said in an email to members, signed by Stratfor Chief Executive George Friedman and passed on to AP by subscribers, that it had hired a "leading identity theft protection and monitoring service" on behalf of the Stratfor members affected by the attack. The company said it will send another email on services for affected members by Wednesday.

Stratfor acknowledged that an "unauthorized party" had revealed personal information and credit card data of some of its members.

The company had sent another email to subscribers earlier in the day saying it had suspended its servers and email after learning that its website had been hacked.

One member of the hacking group, who uses the handle AnonymousAbu on Twitter, claimed that more than 90,000 credit cards from law enforcement, the intelligence community and journalists ? "corporate/exec accounts of people like Fox" News ? had been hacked and used to "steal a million dollars" and make donations.

It was impossible to verify where credit card details were used. Fox News was not on the excerpted list of Stratfor members posted online, but other media organizations including MSNBC and Al-Jazeera English appeared in the file.

Anonymous warned it has "enough targets lined up to extend the fun fun fun of LulzXmas through the entire next week."

The group has previously claimed responsibility for attacks on credit card companies Visa Inc. and MasterCard Inc., eBay Inc.'s PayPal, as well as other groups in the music industry and the Church of Scientology.

Man killed during London Boxing Day sales stampede

"There were four armed policemen trying to bring him back to life. His friend was holding his hand. He couldn't talk. Then he just dropped his hand as if he had given up.

"When the police told his friend that he wasn't going to make it, he just started screaming. There was blood everywhere. I ran into Boots, I was scared something else was going to happen."

A fight is thought to have taken place shortly before the incident. Seven arrests were made and a lock knife was understood to have been recovered from a nearby street. Grieving members of the victim's family arrived at the scene and were comforted by officers.

Rumours spread on Twitter that someone had been shot while other users posted images of a blood-splattered flick-knife lying near a cordon.

Lance Gracious wrote on Twitter: "Someone stabbed outside Footlocker Oxford Street, it was Christmas yesterday, what's up with these people?"

A large section of Oxford Street was closed as forensic teams scoured the area. Debenhams, Boots and The Disney Store were closed.

It is believed paramedics attempted to revive the injured man but he was pronounced dead on arrival at hospital.

A spokesman for The Metropolitan Police said: "The victim was stabbed at the junction between Oxford Street and Stratford Place, at about 13:45 GMT, close to Bond Street Tube station.

"He is thought to be in his late teens or early 20s and died at the scene.

"A section of Oxford Street, close to the underground station, has been closed while investigations continue."

The death came as huge numbers of Britons were expected to spend ?1.8 billion in a high street stampede as the Christmas sales started today.

Shoppers in London had already faced disruption as Tube went on strike over a pay dispute.

Earlier in the day minor tussles broke out as people fought to get their hands on cut-price handbags from labels such as Prada and Gucci.

Clothing retailer Next employed staff to stand outside marshalling the queues as they filed inside.

Many stores had slashed the prices of some goods by over 70 per cent, and introduced special 'Boxing Day only' deals on certain popular items.

Pakistan registered its third straight victory to lead China 3-0 in the four-match series, the first international hockey competition held in this country since 2004.

Pakistan won the third match of the series Saturday afternoon in Faisalabad 3-1. The hosts had already won the first two matches 3-0 and 5-3 in the southern port city of Karachi, Xinhua reported.

Pakistani striker Ali Shan opened the scoring in the second minute. Veteran Shakeel Abbasi doubled the lead in the 21st minute.

Pakistan led 2-0 at the interval, but China pulled one goal back to make it 2-1 thanks to a penalty scored by skipper Liu Yixian in the 61st minute.

Three minutes later Pakistan's Waqas Sharif extended the hosts advantage again to seal the victory.

International sports events had been stopped in Pakistan due to the refusal of international teams after a terrorist attack on the Sri Lankan cricket team in March 2009 in Lahore.

The 28-member Chinese hockey team is the first international team to tour Pakistan in the last seven years.

Though many individual international players toured Pakistan during the last few years, China is the first international hockey team visiting Pakistan after 2004 Junior Asia Cup held in Pakistan.

Halliburton And Schlumberger Will Benefit From An Increase In Oil Majors' Capital Expenditures

Recently, TheStreet.com dubbed Halliburton (HAL) 'The Most Mispriced Energy Stock of 2011.' The article blames a "Macondo overhang,...fears of pricing weakness,...and a [projected] BRIC slowdown" in 2012 for the underperformance of Halliburton's shares. These concerns seem largely overblown. As for the Macondo issue, there is certainly a real risk that Halliburton may be forced into a large settlement, but S&P does not believe a ruling on the matter is imminent. Regarding a slowdown in the BRIC countries, the article notes that Argus Research believes a review of big oil's capital expenditure plans should be enough to dispel the notion that an economic slowdown in China or Brazil will derail oilfield service companies in 2012.

This is consistent with S&P's outlook for the oil and gas equipment and services sub-industry. In its stock report on Halliburton, S&P says it expects "higher upstream capex...combined with higher global demand" in the coming year. There are multiple examples of big oil's plan to increase spending in 2012. On December 2, Conoco Phillips (COP) announced it was increasing 2012 planned capex to $15.5 billion from a previous estimate of around $14.5 billion. The new estimate represents a 15% increase from 2011. In a sign of how the industry is recovering since oil prices crashed to around $30 in the wake of 2008's financial crisis, Conoco's 2012 spending plan "mark[s] a return to the level of investment the company had before 2009, when it slashed its spending plans by 40%" according to the Wall Street Journal.

Also, Conoco said "the bulk of [its] exploration and production capital program will be spent in North America," where Halliburton maintains a leadership position. Chevron (CVX) also plans to increase capex in 2012. The second-largest U.S. oil company said it expects to increase spending by 17% next year to $32.7 billion, a record for the company, while Exxon (XOM), the largest U.S. oil company, is expected to increase spending by 5% next year according to MarketWatch.

Going forward, the European situation poses a significant risk for oil companies. Should the ECB's Long Term Refinancing Operations fail to spur investment in distressed sovereign debt, Italy and Spain could find themselves unable to access the bond market, causing them to seek a bailout from the IMF. This would likely spark a recession in Europe that could be deep enough to cause significant demand destruction for oil, thus putting downward pressure on prices. Thus far, Europe has navigated the crisis reasonably well--to date, the region's leaders have managed to avert a 'Lehman event'. The likely scenario is that Europe will manage to limp through the crisis without anything going disastrously wrong.

Additionally, geopolitical factors, such as Iran's threat to close the Strait of Hormuz, should counterbalance recessionary fears in Europe. Furthermore, Forbes notes that JP Morgan's commodities research team is predicting that "as a result of producers rebalancing supply and demand," oil prices should remain resilient in 2012, while "past recessions and the price movement of oil [indicate] the floor [for Brent] seems to be in the $80 to $95 a barrel range." The aforementioned Forbes article cites JP Morgan as predicting a 2012 average of $115 for Brent. This bodes well for oil field services companies as "oil and gas companies in aggregate [are] basing 2012 capital spending budgets on an average oil price of $87 WTI and $98 Brent," according to Barclays. This means prices have some leeway to drop before the capex budgets of the oil majors would be affected.

Given that increased capex expenditures should support oilfield service companies in 2012, the question remains: Why Halliburton and not Schlumberger (SLB)? For starters, Halliburton maintains a leadership position in North America. This is good in the current environment given that, according to Barclays, "supermajors will increase spending by 25% in North America [and only] 10% internationally"--Schlumberger derives nearly 73% of its income outside North America. Additionally, Schlumberger is more expensive in both absolute terms and in terms of its earnings multiple. Schlumberger trades for around 14 times forward earnings--shares of Halliburton trade hands for around 8.14 times analysts' consensus estimate of $4.15 for 2012.

Also, Halliburton's trailing twelve month price-to-sales and price-to-cash flow are well below Schlumberger's, and the two companies' trailing twelve month gross margins, operating margins and net profit margins are very similar. All-in-all then, both Schlumberger and Halliburton are poised to benefit from increased capex by oil and gas companies in 2012, but Halliburton seems to be a better value from a valuation perspective. Now seems like a good time to buy, with HAL shares trading around $34.

Clyde Howard, 69, Fort Walton Beach, Florida

Mr. James L. Westbrook, age 78, of Shalimar, Florida passed away Tuesday, December 20, 2011 at his home. Born and raised in Baskett, Kentucky on April 24, 1933 to the late Mattie and John Westbrook.

A retired Staff Sergeant in the U.S.A.F. with 20 years of service; he was a veteran of the Korean Conflict. He was a coal miner for many years and worked with the N.W.F. Daily News until his retirement. James was an avid hunter and fisherman.

James was preceded in death by his brothers, John and Tommy Westbrook, survived by his beloved wife of 48 years, Judy Westbrook of Shalimar, Florida, son, James Westbrook, Jr. (Wendy), of Virginia Beach, VA, daughters, Janet Maricich of Houston, TX, Jeanna Wood (Gary), of St. Charles, MO, Sheila Tuck (Randall), Evansville, IN, 12 grandchildren and 6 great grandchildren.

A memorial service will be held Thursday, December 29, 2011 at 2:00 P.M. at Emerald Coast Funeral Home, 113 Racetrack Road, N.E., Fort Walton Beach, Florida. Inurnment will be at Barrancas National Cemetery in Pensacola, Florida

Wambach is top female

With the final seconds ticking down and the Americans on the verge of their earliest exit ever from the Women's World Cup, Abby Wambach kept waving her index finger at her teammates.

One chance, she screamed, all they needed was one chance.

When it came in the form of a left-footed cross from Megan Rapinoe, Wambach pounced. With one vicious whip of her head, she changed the course of this year's World Cup and sparked a nationwide frenzy rarely seen for women's sports.

Wambach's clutch performance at the recent women's World Cup soccer tournament made her the clear choice for the 2011 Female Athlete of the Year, selected by members of The Associated Press. Floyd Mayweather Jr. was sentenced to 90 days in jail after pleading guilty to reduced battery domestic violence and harassment charges before a Las Vegas judge. Mayweather, 34, also was ordered to complete 100 hours of community service and pay a $2,500 fine. The plea deal avoids trial on felony allegations that he hit his ex-girlfriend and threatened two of their children during an argument at her home in September 2010.

Auto racing

Roger Penske hired AJ Allmendinger to replace Kurt Busch in the No. 22 car. Allmendinger, 30, had 10 top-10 finishes and was 15th in points driving Richard Petty's No. 43 car. Busch won two races, took three poles and was one of 12 drivers to compete in the season-ending chase. Two weeks ago, after six bumpy seasons, Busch and Penske parted ways.

College

Connecticut is drafting a new policy that would require all employees to report any allegation of sexual abuse.The policy is expected to be presented to the school's Board of Trustees in January.

Olympics

Peter Forsberg is backtracking on comments he made in a TV interview suggesting Sweden threw a group-stage hockey game in the 2006 Olympics to get an easier draw in the second round. A 3-0 loss to Slovakia meant Sweden, which went on to win the tournament, faced Switzerland instead of Canada in the quarterfinals. In an interview that aired Sunday, Forsberg told Swedish broadcaster SVT that he "saw no reason to win the game" against Slovakia and the players figured "it's probably better if we don't go out and tire ourselves out too much." On Wednesday, Forsberg said his comments were taken out of context.

Soccer

England captain John Terry faces a criminal charge over allegations that he racially abused an opponent in the Premier League. Britain's Crown Prosecution Service decided there is sufficient evidence to prosecute the Chelsea defender for his on-field exchange Oct. 23 with Queens Park Rangers defender Anton Ferdinand.

Analysis: GOP's struggle on taxes gives Dems hope (AP)

WASHINGTON ? For all his problems with the economy, President Barack Obama is getting unexpected help from a Republican Party that seems incapable of capitalizing on its advantages.

Congressional Republicans' fumbling of the payroll tax extension issue is the latest example of party in-fighting and disarray that gives Democrats hope for the 2012 elections. GOP presidential contenders tried to distance themselves from the legislative mess. But they might be tarred nonetheless if swing voters decide the party is either inept at governing or too extreme.

The eventual GOP presidential nominee "will be somewhat shackled to the Republican brand," said Democratic strategist Erik Smith, even if it was Republicans in Congress who led the charge in an unpopular fight over the payroll tax. He said GOP House and Senate candidates will face even more problems.

The Wall Street Journal editorial page ? an important voice among conservatives ? berated Republican lawmakers for their handling of the payroll tax matter. Obama wanted to add another year to this year's reduction in the tax, which nearly all workers pay toward Social Security. Senate Republicans, after forcing Democrats to swallow several unrelated concessions, joined in an overwhelmingly bipartisan vote to approve only a two-month tax cut extension, with plans to revisit the issue next year.

House Republicans, who generally disliked the payroll tax cut from the start, refused to concur early this week. But House Speaker John Boehner on Thursday bowed to relentless criticism from conservative bloggers and several GOP senators and cleared a path for passing a bill Friday to renew the break for two months while congressional negotiators work on a longer-term measure.

If Congress doesn't act in the next 10 days, the payroll tax rate will return to 6.2 percent on Jan. 1, after one year at 4.2 percent. That would cost a family making $50,000 about $1,000.

Republican congressional leaders' actions "might end up re-electing the president before the 2012 campaign even begins in earnest," the Journal's editorial page said Wednesday.

Democrats point to episodes like the payroll tax fuss and say congressional Republicans are essentially controlled by tea party activists, whose tax and spending agendas are outside the political mainstream.

"Tea Party Republicans blocked a bipartisan bill to extend President Obama's payroll tax cut," the Democratic Congressional Campaign Committee said in a fundraising email Tuesday, minutes after a key House vote. House Democratic leader Nancy Pelosi told reporters, "The tea party tail is wagging the elephant."

Democratic strategists hope to remind voters of last summer's near-calamity over raising the limit on the federal debt ceiling. Then, as now, Boehner struggled to control his GOP caucus and to calculate which bills can and cannot pass. These Democrats want to paint the Republican Party as an out-of-touch institution that would rather stand for rigidly conservative principles than solve the nation's problems.

"I think the tea party-engendered dysfunction has the potential to really get the electorate's attention," said Jared Bernstein, a former Obama administration economist now with the Center on Budget and Policy Priorities. "At this point, the system is crippled by them."

All of this, of course, may be wishful thinking by Democrats. Republicans crushed them in the 2010 elections, giving the GOP control of the House and many governorships. Unemployment and other economic indicators bode badly for Obama's re-election hopes, and the payroll tax dust-up may seem a musty memory by next November.

One other worry looms. Americans' taxes still might rise by billions of dollars in 2012 if a deal can't be struck on a longer, one-year extension. Economists say that would depress spending and slow job growth, at least somewhat. Even if more voters blame Republicans than Democrats, Obama could end up as a net loser politically, given that the economic climate already is deeply troublesome for him.

GOP leaders say income tax cuts do more to stimulate economic growth than payroll tax reductions but worry about independents thinking it was Republicans who sought to raise their payroll taxes. At the same time, they know that hard-core conservative voters who have a bigger voice in GOP primaries might blame them for a tax cut they dislike.

Republicans may yet claim one political victory out of the payroll tax imbroglio, assuming the two-month extension goes through. In House-Senate negotiations they forced Obama to agree to an expedited decision on a proposed transcontinental oil pipeline opposed by environmental groups as part of the two-month extension.

The GOP still has a perception problem, though. Americans hold Congress in extremely low regard, but they put more blame on Republicans than Democrats.

A recent poll by the Pew Research Center found that a record-high 50 percent of Americans say the current Congress is less effective than most. By nearly 2-to-1, "more blame Republican leaders than Democratic leaders for this," Pew found. "By wide margins, the GOP is seen as the party that is more extreme in its positions, less willing to work with the other side to get things done, and less honest and ethical in the way it governs. And for the first time in over two years, the Democratic Party has gained the edge as the party better able to manage the federal government."

Presidential buzz surrounds leading figure of Russia's protest movement

Alexei Navalny, a vocal critic of Putin and leader in Russia's protest movement, could pose a tough threat to his presidential bid.

Russian blogger-cum-folk-hero Alexei Navalny, who is already being discussed as a potential contender to challenge Vladimir Putin in upcoming presidential polls, was released from a Moscow prison Wednesday to the wild cheers of supporters.

Mr. Navalny, whose trenchant and well-documented attacks on Kremlin corruption?have migrated from the Internet to the streets in recent weeks, was arrested and sentenced to 15 days in prison after he took part in an unsanctioned rally to protest alleged vote-rigging in Russia's Dec. 4 parliamentary election.

"These 15 days have taught me not to be afraid. I am not alone. We are the majority," he told a jubilant crowd of supporters.?"I was imprisoned in one country and am being released into another," he added.

He pledged "extraordinary efforts" to build momentum in the protest movement, which saw at least 30,000 mostly young and middle class demonstrators rally on Moscow's Bolotnaya Square on Dec. 10 to demand that the allegedly fraud-tainted elections be cancelled and re-staged under fair rules and conditions.

The next rally is set for this Saturday in Moscow, and well over 30,000 people have already signed a Facebook-based pledge to attend. Russian authorities have permitted the rally, but given?covert police actions aimed at discrediting leaders and splitting the movement, they may be extremely worried that the protests could become a real threat to Kremlin dominance.

Navalny is the author of the term "party of rogues and thieves" to describe Mr. Putin's ruling United Russia party (UR), a phrase that went viral in Russia and may have contributed as much as any other factor to UR's massive loss of support in the election.

Even with what critics estimate as up to 20 percent fraudulent boost in its vote tally, UR barely managed to eke out a 50 percent victory in the polls.

After the New Year break, Russia will launch into presidential polls that will see Putin face off against handful of drearily familiar, lackluster opponents, including Communist Party leader Gennady Zyuganov, ultranationalist Vladimir Zhirinovsky and liberal Yabloko chief Grigory Yavlinsky ? most of whom?have been defeated repeatedly in set-piece elections by Putin.?

A new contender is tycoon Mikhail Prokhorov,?who announced his candidacy last week in the wake of the massive Moscow protest. But few think Mr. Prokhorov, a superwealthy "oligarch" who gained his fortune through murky wheeling-and-dealing in the wild 1990s, can attract any votes beyond Russia's narrow business and emerging professional elites.

Many experts say Navalny, with his street cred and reputation as a democratic nationalist, could be the candidate to appeal beyond the confines of downtown Moscow and pose a genuine challenge in Putin's vast provincial and working class base ? if he were allowed to run.

"I think Navalny is the leader of the future," says Konstantin Bakulev, director of the independent Institute of Socio-Economic Modernization in Moscow. "He has all the right things going for him: he's a new face, not linked to any of the old-line political parties, and he's really trending right now. People say he's a nationalist, but he's really a patriot. If he proves he can work with people, he will go places."

Upon his release Wednesday morning, Navalny fueled speculation about a possible presidential run by aiming a sharp rhetorical barb at Putin personally.

"The party of rogues and thieves is putting forward its chief rogue and its top thief to run for the presidency," Navalny said. "We must vote against him, struggle against him."

RIM purportedly shopped by Microsoft and Nokia, talked with Samsung / HTC about licensing

Tomorrow's headlines: local florist and rural farmer consider purchase of RIM, or at least the "In Motion" part. Hot on the heels of a report suggesting that Amazon was at least considering a purchase of Canada's famed BlackBerry maker, in flies a separate report suggesting... well, all sorts of insane things. For one, The Wall Street Journal is reporting that Microsoft and Nokia "flirted with the idea of making a joint bid" for RIM in recent months, with the status of the talks today being "unclear."

Of course, the fact that these talks are even ongoing says a lot about the internal happenings at the company, and with co-CEO Jim Balsillie recently suggesting that "no stone" would be left unturned in a bid to turn the corner, it doesn't take a professional Between The Lines reader to make sense of it all. Crazier still, two other folks "familiar with the situation" have said that RIM executives have "approached other smartphone makers, including Samsung and HTC, about licensing RIM's new operating system," presumably BBX BlackBerry 10. If anyone else decides they too are interested in having a talk with these guys (read: it's highly likely), we'll be sure to let you know.
