Q: In the state of Tennessee, I am selling a house. The 6% commission will be split between my listing agent and the agent for the buyer. Is not the agent for the buyer obligated to protect and promote my, the seller?s, interest since I, the buyer, am paying them a commission?

A: The listing agent has your best interest at heart. However, the buyer?s agent has the fiduciary duty to promote the buyer?s best interest first and foremost. Whether you, the seller, pay the commission is not relevant ? remember that you have a contract (listing agreement) with the listing agent (who in turn shares commissions paid with the buyer?s agent as per their cooperative agreement).
